One-Day Mediated Divorce or Custody Agreement

Mediation helps couples resolve their divorce or custody issues with the help of a neutral mediator. If both parties are ready to reach a resolution, mediation has a very high success rate even for difficult issues.

This package is for couples to resolve their issues without having their own attorneys. If one or both parties want to have their own attorney participate in the mediation, this package does not apply as the process and the price are different.

Mediation generally starts by calling each party separately and understanding his or her position and point of view. This call can take up to two hours. For a divorce, the parties will need a comprehensive list of all the assets and debts.

After talking with each party, the mediator will frequently give the parties ‘homework’ to do. This could be appraising an asset (such as a house) or providing additional documents.

Once the parties have come up with a list of assets and debts (for a divorce) and completed any ‘homework,’ everyone will meet together for a day (seven hours) in order to resolve any outstanding issues.

The basic package includes:

• The initial free, no obligation, telephone consultation;
• An in-person (or Zoom) consultation (up to two hours);
• Up to two hours talking with each party prior to the mediation.
• One day (seven hours) of mediation.
• Drafting the documents regularly required to obtain a divorce or custody agreement in Clark County, Nevada, including:
• Joint Petition or a Complaint and Answer;
• Affidavit of Resident Witness;
• Request for Summary Disposition;
• Affidavit in Support of Request for Summary Disposition;
• Decree of Divorce or Decree of Custody;
• Up to one hour with an attorney to review the prepared documents and explain their contents.

For this service, Sandpiper does not represent or advocate for either party. Either party may consult an independent attorney before signing.

Even though mediation has a very high success rate, there is no guarantee you will reach an agreement. If you are unable to reach an agreement, you can either opt for additional mediation time (with additional fees), or receive a refund of $500 because no documents will be drafted.

Current Clark County filing fees for a divorce are generally $299 for a Joint Petition. When a Complaint and Answer are used, the combined filing fees total $516 ($299 for the Complaint plus $217 for the Answer). For a Custody Decree, a Joint Petition is generally $259. When a Complaint and Answer are used for custody only, the filing fees total $476 ($259 for the Complaint plus $217 for the Answer). Court fees are paid separately and may change.

Dividing a pension, 401(k), or other qualified retirement benefit may require a separate Qualified Domestic Relations Order (QDRO). These orders are not included in the basic package.

This package does not include:

• Investigation, discovery, or verification of income, assets or debts;
• Asset appraisals, business valuations, or complex financial calculations;
• QDROs, deeds, loans, leases, or other separate agreements;
• Motions, court appearances, contested proceedings, or additional filings;
• Sealing records, certified copies, or third-party expenses;
• Revisions caused by changes to the agreed terms.

If the court rejects your divorce or custody agreement due to a drafting error, Sandpiper will correct the error with no additional attorney fees. If Sandpiper cannot correct the error, it will refund the package fee. This guarantee does not cover filing fees, third-party costs, or any initial consultation fee.
